Donald Trump’s lawyers have filed a new filing arguing that Fulton County District Attorney Fani Willis should testify again in light of new evidence in her disqualification hearing. The case involves Trump and 18 co-defendants accused of conspiring to overturn Joe Biden’s 2020 election win in Georgia. Trump has pleaded not guilty to all charges and claimed the case was politically motivated as he is the GOP frontrunner in the 2024 presidential election. Judge Scott McAfee has held hearings to determine if Willis and her office will be disqualified from the case due to the personal relationship between the district attorney and Nathan Wade. Trump and some of his co-defendants argued for the removal of Willis’ office and the entire case to be dropped due to what they perceive as a conflict of interest.
Willis and Wade claim that their relationship started in the spring of 2022 after Willis hired him and that neither have financially benefitted from it. Trump’s lawyers filed a supplemental brief to McAfee, asking him to review new information including an affidavit from a private investigator, Charles Mittelstadt, who analyzed Wade’s cellphone location data. The investigator said that in 2021, Wade arrived at Willis’ home late at night twice and left in the early morning hours, once in September and the other in November.
Trump’s lawyers argue that the records do not prove the content of the communications between Special Prosecutor Wade and District Attorney Willis, nor that Special Prosecutor Wade and District Attorney Willis were ever at any particular location or address. They believe that only two people know what was happening in the house between midnight and 3:28 a.m. on September 12 or between midnight and 5:00 a.m. on November 30.
